State and Federal Aid Essay There are many past and rising issues involving public school finance. The public schools system is funded through federal, state and local taxes. Each state has different formulas to distribute funding from state and local taxes. Federal funding does contribute to the rising cost of education for each state. State and local taxes is allocated to cover the majority of educational costs. Student achievement depends upon the available funding allotted to each district. This author will attempt to discuss equalization of federal, state and local funding. Also, this author will attempt to describe fair, equitable and adequate tax systems. Federal, state and local funding are all important to the funding formula for public education in Texas. A large chunk of funding for Texas schools comes from sales tax. Every item that is purchased, with the exception of food, has a sales tax added on. Ultimately, all consumers contribute to the public education system. Every other week in the news, there are stories covering the rising costs of oil and gas. Every time we fill our gas tanks, we are paying taxes that go towards local funding of education. Many districts in Texas are filled with low economic status students, and are Title I campuses. Title I campuses provide free and reduced breakfast and lunch for students. These free and reduced meals are provided each school day. Title I campuses in Texas receive federal funding for the free and reduced lunch program. Each parent, every school year, is encouraged to complete paperwork for each student to qualify for the program. Throughout the history of public education the big question has been, ââ¬Å"How can the funding of public education be equal and equitable?â⬠Each state receives federal funding with the intent of the federal government to provide equal and equitable education to all children. The federal funding received by each state is allocated towards the basic necessities that are needed for education. Additional funding is needed for the many resources and developmental trainings that are also needed to provide adequate education. This is when state and local funding are important and added to the equation. This is also the reason given by many school districts on the importance of increasing state and local taxes. Each year school districts receive reports on accountability from the state. With these reports school boards have decisions to make. These decisions all deal with what is neededà to improve and increase accountability. In turn, discussions of where funding should be allocated and how to generate more funding. To increase local taxes would be a source of increased funding. Then, parents as well as community members would have to vote on the decision to increase taxes. Usually, members of the community are not eager to support a vote of increased taxes. The rising cost of education is not something that general community members are concerned with. There are also parents of students in the public education system that are not aware of the increasing cost of quality education. The task of increasing the funding for public education becomes harder each school year. One alternative to increasing taxes to gain more educational funding would be to enlist the support of local and state corporations. Local corporations could be included when sponsoring extracurricular school events. These extracurricular events should not be designated to only sporting events. Corporate support should be solicited to sponsor fine arts, sporting, community as well as back to school events. Corporations could use these opportunities as advertising and a source of generating revenue. In turn, these corporations would have relative concern for the success of the districtââ¬â¢s students. This relationship would also generate funds to support equitable and adequate public education. There have been attempts made to change the way education in Texas is funded. Previous proposals included increasing sales tax instead of including property taxes. This proposal was rejected because citizens desire more local control. While this proposal would hand over more control of public education to the state. As stated by Lavine (2007), by allowing the state to provide more funding, the link between local taxpayers and public schools would be broken. Community members have more stake in school districts when their tax monies fund local schools. A fair, equitable and adequate tax system would share the wealth of local taxes. Is it possible to have a fair distribution of funding for public education? Each year when income taxes are filed and people pay taxes on wages earned and property owned. There is a standard tax bracket that is followed to determine the amount of taxes paid by each citizen. Public education funding and our students would benefit from a similar bracket. The bracket should be utilized by the state. The districts with the higher numbers of economically disadvantaged students should receive more funding from the state. This method would provide equalà funding from the state. Local funding would allow for continued support from community members and businesses. Another alternative method of generating funds for education would be to re-establish district zones. Some may argue that in re-establishing district lines, some districts may lose funding while others would gain. The re-establishment of lines would support the equality of education that is described in No Child Left Behind. As stated by McCown (2006), consolidating smaller districts is not the problem but more financially supported, larger districts should be re-zoned. By re-establishing district lines, the wealth and funding for public education would be shared. If federal, state and local funding was equal for every district; would that be equal and fair funding for education? Conclusion Our public school system in Texas is operated through the use of federal, state and local funding. Local funding is generated from property taxes levied from commercial and public property. Educational funding from the state is generated from taxes such as oil, gas and also sales taxes. Federal funding is specifically allocated towards free and reduced breakfast and lunch programs, bilingual and special education and also technology. The education system of today requires more funding than what was needed fifty years ago. The funding generated from federal, state and local governments is not adequate enough to support the changing system of education. The idea that public education I both equitable and adequate is becoming harder to believe. There is a need to increase local funding but community members are not in support of tax increase. We need to enlist the use of alternative methods to generate funds for public education. Children of Texas depend on the public education system to provide them with opportunities to create better futures and successful citizens. Understanding the political structure of a country is very important when trying to do business internationally. When multinational corporations plan to invest in a new country they must understand the political system and culture. Bolivia has faced political instability for over the past century. Since Evo Morales was elected as president, many changes have been made to protect some of the natural resources and mandate foreign investment. Moralesââ¬â¢ political influence has played a large roll in the regulation of foreign investment and business. Since his inauguration, Morales has nationalized the hydrocarbon industry and the telecommunication industry. This has caused many companies to negotiate new contracts. Although Boliviaââ¬â¢s legal framework is open to foreign investment, many foreign companies and investors are affected by many of the inconsistent regulatory decisions. These issues often cause uncertainty with investors when deciding to invest. In addition the easily corrupted judicial system also causes a threat to many investors that decided to invest in Bolivia. Several problems that come up when investing in Bolivia result from the weak judicial system. Many of the property and contractual rights might be enforced, but the process can take a lot of time due to corruption and political influence. This also could be a potential threat to companies that want to expand into Bolivia. Political protests against the government are another issue that might affect foreign investors when attempting to do business in Bolivia. Many of these protest cause disruption to the transportation of goods. Overall the political environment of Bolivia could potentially cause issues when doing business; we might put ourselves at risk of losing major profits or even expropriation by the socialist form of government currently established in Bolivia. Economic Analysis Bolivia has struggled economically in the past thirty years but has reached stability. This is partially due to low population growth that has kept the labor supply limited. Another key factor to the economic struggle in Bolivia is due to the political and social conflicts within Bolivian society. Many changes have been implemented after the economic crisis in 1984-1985, where they suffered from extreme hyperinflation. The main focus of the government after the period of hyperinflation was to maintain price stability, create conditions for sustained growth, and alleviate poverty across the country. Currently Bolivia relies heavily on foreign assistance to finance developmental projects. Direct foreign investment has contributed much of the growth experienced in private investment in Bolivia. Boliviaââ¬â¢s primary sectors, Agriculture/Forestry and Mining, have created economical opportunities for Bolivia. Agriculture contributes to almost ten percent of Boliviaââ¬â¢s gross domestic product and almost half of their work force is employed in this industry. One of their most profitable products is coca in which they are currently the third largest cultivator. Mining has played a big part in Bolivia economic growth as well. Many local miners are employed by small-scaled operations throughout the country. Although Bolivia is known to have over 5. 4 million tons of lithium, much of the lithium deposits are not mined due to the disturbance of the country salt flats, which are a big feature of tourism. Currently the United States is one of Boliviaââ¬â¢s largest trading partners, importing $707 million dollars in 2010. There are no laws directly regulating competition but the government does have some regulation on the activities companies have. Bolivia has struggled economically but are now more efficient Social Analysis Many of the issues arising socially are result of the living conditions and political reform. Although much of the population is living in poverty, two-thirds of Boliviaââ¬â¢s population is active within the economy, either working for corporations or on a non-contractual basis. One issue that the majority of the population is dealing with is working qualifications. Many people growing up in Bolivia may only attend one year of schooling. Some of the difficult living conditions and political influences can create a hostile environment throughout the country. Protests against the government are a common issue that might affect foreign investors when attempting to do business in Bolivia. Many of these protest cause disruption to the transportation of goods and can effect business decisions. Violent and disruptive social protests occur often in some of the major cities that have affected companies. There have been cases where the major airports have been shut down for over twenty days due to protesting and social unrest. The government is attempting to increase citizen involvement in politics in order to help decrease some of the protest. Through many political and economical reformations, Bolivia has stabilized many of the past issues they were facing but is still a difficult place to do business, and through time it has deterred many international companies from entering the market. Country Risk Analysis and Globalization As mentioned before, Bolivia constitutes one of the least developed and poorest countries in Latin America and one of the most isolated countries in South America. Boliviaââ¬â¢s socialist leader, Evo Morales, was elected because of his involvement with the anti-globalization movement. He has reduced poverty within the country, redistributed wealth, and has nationalized a significant amount of the energy sector. He has promised to favor domestic consumption of natural gas over export. He has supported mainly by the poor majority who mostly reside in the western highlands. The population residing in the eastern areas and voters from the middle and high class who have most of the wealth, are concerned about his policies. Those in higher social classes are concerned with the neo-liberal global economy while many in the mestizo class support the opportunities that come from participating in the global economy. When it comes to the countryââ¬â¢s globalization, Bolivians have a deep love for the natural richness of their country and are fighting to protect it. Bolivia is rich in nature and has many natural resources to offer. The natureââ¬â¢s conservation of the country is under pressure because of global interests, but itââ¬â¢s an opportunity for Bolivia that can be beneficial to them and help create more stability and less inequality among the country. Bolivia has the second largest reserves after Venezuela and looks like the perfect supplier for natural gas. But in 2005, a hydrocarbons law was passed by the government that imposed higher royalties and required foreign firms who were operating under risk-sharing contracts at the time, to surrender all production to the state energy company in exchange for a predetermined fee. The hydrocarbons sector has raised question as to whether Bolivia has the sectorââ¬â¢s capacity or not to grow. Bolivia will continue to supply Brazil and Argentina with their natural gas but their long-term market potential is at risk. There are a number of factors that may reduce the growth of the industry; increased political risk, delays in infrastructure projects, and insufficient funds for production. The country needs private investment to increase production, but if they continue to pressure investors this is going to be very difficult. Bolivia has had problems with political instability in the past years, which has affected investments in the sector. They had a large fall in investments in exploration and production of about $63 million in 2006. It has had a downfall on the amounts of gas delivered to Argentina since the volume of production decreased in 2007. They had initially agreed that Bolivia would deliver 7. 7 million cubic meters per day per year to Argentina, but Bolivia was only delivering about half of that. Boliviaââ¬â¢s supply to Brazil was almost quadruple of the7. 7 mcm/d per year to Argentina, in turn, Bolivia asked Brazil for help. They are currently working on balancing and maintaining the gas deliveries to Argentina. Political instability in Bolivia has caused them to hinder the opportunity of exporting gas to Chile, to Mexico through liquefied natural gas facilities, and to the U. S. through a Peruvian or Chilean port. Even though Bolivia has faced political instability, they have never stopped its gas supplies to Argentina or Brazil. In consequence to the political instability, the lack of investment in the country has reduced much of the production volumes. The Bolivian government has improved its relationships with other governments regarding negotiations; they also have improved their relationship with Brazil after the gas industry nationalization. Contracts of new investments have been made to initiate more production giving a positive signal for the future gas supplies in the region promising the security of supply for Argentina and Brazil. Although government relations have improved, there is still a risk of markets not developing because of Boliviaââ¬â¢s internal political problems. But if the government avoids these political problems and a more consistent policy framework is made, the future looks promising for Bolivia. Bolivia, being an underdeveloped country, poses economic risks to other countries entering their market. Future growth of the country will be constrained by declining foreign investment and the countryââ¬â¢s high debt. Bolivia has such high poverty rates, that growth probably wonââ¬â¢t reach levels to sufficiently relieve the rates. President Morales opposes free market economic policies and instead supports state involvement in policy making and more government spending on health, education, and infrastructure. The government continues to negotiate for further debt relief of the country. According to the Natural Hot Spot study by the World Bank, Bolivia has the 32nd highest economic risk exposure to three or more hazards. Itââ¬â¢s exposed to detrimental hazards due to the countryââ¬â¢s geographic location as well as the vulnerability of its population and infrastructure. In the past, the country has experienced a series of emergencies caused by many natural disasters such as floods; hail storms, landslides, and mudslides. The levels of vulnerability in Bolivia have increased due to poverty factors and repeated natural disasters in the same regions. Industries and the general population are affected by these events since 49 percent of the population works in the service sector, 40 percent work in agriculture, and 12 percent in industry. Boliviaââ¬â¢s legal framework remains generally open to foreign investment. However, foreign firms may be affected by inconsistent regulatory decisions, unfavorable interpretations of laws, and a corrupted judicial system. The Investment Law provides for national treatment of foreign firms and guarantees the foreign firms their profits, the free exchange of currency, and the right to international arbitration in all sectors. Laws that govern activities having to do in the mining and hydrocarbon sectors authorize joint ventures, and association of services to state-owned corporations. The Hydrocarbon Laws, which was issued in May of 2005, required investors to adapt to new contracts within 180 days, forced production of hydrocarbons to release all hydrocarbons to the state, and forced an additional tax of 32 percent on revenues. The law also required that before exporting, companies sell their hydrocarbons and satisfy the domestic market at factitious prices set by the hydrocarbons regulator. Boliviaââ¬â¢s currency is freely convertible at Bolivian banks or exchange institutions. The official exchange rate is determined by the Central Bank who auctionââ¬â¢s dollars daily; the bank offers a set amount of dollars and offers a minimum price. The Banking Law establishes regulations for foreign currency hedging and allows banks to have accounts in foreign currencies. There are no restrictions of any sort on transfers of currency. In 2007, the Central Bank established a one percent fee for any money transfer that is larger than one thousand U. S. dollars. Any hard-currency cash larger than ten thousand U. S. dollars must be authorized by the Central Bank and Ministry of Finance if itââ¬â¢s leaving or entering the country. Boliviaââ¬â¢s past has hindered the investment of foreign firms is their country. Through their political and economic instability the country has yet to fully flourish in the agricultural sector. Some low population growth as well as low life expectancy and a high rate of disease has constrained the labor supply and prevented industries from flourishing. However, the period was not determined, but according to the judge, assistant should be provided until the employee is fit to cope with his work again. This at least gives employers a possible choice when they face with such situation. Nonetheless, although it seems morally right to require employers to provide for employees, this might be too heavy a burden for employers. As the labour market becomes more competitive, it is more likely that individual workers would want to assume more responsibility. Some would argue that it is not fair for an employer to determine how much responsibilities can an employee hold. According to Lord Rodger of Earlsferry in Barber, in cases where an employee is liable to develop some illness if he carries out the job which he is employed to do, the employer owes him a duty of care to continue to employ him to perform that job. Devlin LJ in Withers v Perry Chain Co Ltd was quoted by Lord Rodger, ââ¬Ëthe employee is free to decide for herself what risks she will run. I agree with Sellers LJ that if the common law were to be otherwise it would be oppressive to the employee, by limiting his ability to find work, rather than beneficial to him.ââ¬â¢ Therefore, in this modern world, e mployers should not be subject to any limitation as to what should they do to prevent their employers from suffering mental illness as a result of stress from work. The court should recognise that they do have their own responsibilities as well therefore should not force them to provide too much for the workers. Hale LJ was quoted by Lord Scott in paragraph 6 of his judgement in Barber: ââ¬Ëunless he knows of some particular problem or vulnerability, an employer is usually entitiled to assume that his employee is up to the normal pressures of the jobâ⬠¦. An employee who returns to work after a period of sickness without making further disclosure or explanation to his employer is usually implying that he believes himself fit to return to work which was doing before.ââ¬â¢ It is of common sense that an employer will not know if he was not informed. Judging from the heavy workload of everyone including the employer himself, it would be very unfair to require him/her to still take positive action to examine into every suspicious situation. Moreover, in this case, Mr. Barber has problem communicating the problem he faced even to his general practitioner. The atmosphere in offices is no longer like the olden days where workers have time to take a rest for tea and have short chats now and then. It is usually so busy that they would not even talk to each other while they were in offices. The test set out by Hale LJ was accepted by the Lordships. In this test, it is said that the indications of impending harm to health arising from stress at work must be plain enough for any reasonable employer to realise and take action. Therefore it is unrealistic to set too high a standard of care for the employers. It should be noted that the Lordships basically agree with Hale LJ approach in assessing how liable the City Council are as the employer of Mr. Barber. However, it is the facts of the case assumed by the majority and minority which differs. The majority assumed that Mr. Barberââ¬â¢s meeting with all the 3 members of the senior management team(SMT) has been effective in giving them the message that he was under such immense pressure that he could not bear it anymore. The dissenting judgements felt that his action was not obvious enough. The real world is complicated. It can be said that the SMT has been really careless to not notice; but everyone in the school was under the same pressure. There is possibility that the House of Lord wanted Barber to serve as a reminder to all the other employers. Is Animal Testing Really Necessary Essay Animal testing is a phrase that most people have heard but are perhaps still unsure of exactly what is involved. Whether it is referred to as animal testing, animal experimentation or animal research, it means the experimentation carried out on animals. Experimental animal testing has been one of the highest debated issues for many years. Animal testing is used for numerous products and applications. Everything from toiletries to medications has likely been tested on animals at some point prior to their distribution (Murnaghan). Animal testing can be conducted anywhere from a university to a military defense establishment, wherever there is a need for testing a product. Products to be tested will range from cosmetics to pesticides and anything in-between. Animal testing has been around for over 500 years, since the early 17th century, though testing for cosmetic purposes did not start until the 1930s. Animal testing has been highly debated for many years for whether it is moral, ethical, humane, right, wrong, just, fair, etcetera. Many people stand against animal testing because they feel that it is unfair treatment to animals since animals do not have a say in the matter. On the other side of the argument, people fight for animal testing because it allows for prescription drugs and medicines to be tested. Both sides have their valid points, animal testing can be seen as cruel, especially when there are alternatives that can be used, but also, even with alternatives, testing on animals is still sometimes necessary in order to get the needed results. In a debate between Laurie Pycroft, one of the founders of Pro-Test, and Helen Marston, head of Humane Research Australia, the two go back and forth about animal testing and its potential alternatives. Pycroft starts out the debate by explaining the complexity of the human body and how no investigative tool can ââ¬Å"fully replicate the intricacy of a living organismâ⬠(Pycroft). Marston returns fire by talking about why animals are not good models for human medicine. She makes the point that animals are ââ¬Å"anatomically, genetically, and metabolicallyâ⬠different from humans (Pycroft). Pycroft continues to bring up different examples of how using animals for research has helped make medical advances for humans, while Marston seems to continue to revolve around the same idea of there being alternatives, but she does not really expand on any one topic, just that there are alternatives. Thomas Hartung talks about the alternatives to animal testing. One of the things Hartung mentions is an experiment done in 2006, ââ¬Å"when the TeGenero anti-CD28 antibody, after testing safe at 500-times higher concentrations in monkeys, [it still] led to multiple organ failure within hours in six human volunteersâ⬠(Hartung). Thus, providing an argument against animal testing because sometimes, even when animal testing provides positive results, it does not mean that the same result will be present when human trials are done. Many people believe that animal testing is only about testing cosmetics or new drug therapies, however, there are many different uses for animal testing, and Timothy Musch et al discuss some of those uses. ââ¬Å"Animal studies play a part in the initial development of candidate drugs, and the development and testing of medical devices and surgical procedures. Even more crucial, animal research informs clinical research by building the foundation of biological knowledgeâ⬠(Musch et al). There are so many things that the testing of animals can help to improve. Some things, such as the development of insulin, antibiotics, vaccines, and drugs with high mortality rates, are all because of high contribution from animal testing (Murnaghan). On the flip side though, Alison Abbott points out, ââ¬Å"Every time you reach for an eye drop or reapply a lip salve, you do so confident that the chemicals they contain are safe to use. But the toxicology test on which regulators rely to gather this information are stuck in a time warp, and are largely based on wasteful and often poorly predictive animal experimentsâ⬠(Abbott). Abbott talks about a legislation called REACH (Registration, Evaluation and Authorization of Chemicals) and how it planned to ââ¬Å"make registration mandatory for both future and existing chemicals ââ¬â even those that have been on the market for decadesâ⬠(Abbott). As a result of reach, it was expected that millions more animals would be used in order to meet the necessary requirements. 5,000 animals ââ¬â that is up to how many test subjects could be used for each chemical; if it is a pesticide that number jumps to 12,000. The estimated cost of running these tests on the unregistered (approximately 30,000) chemicals is between â⠬5 billion (US$6 billion) and â⠬10 billion (US$13 billion) (Abbott). In order to test one single chemical for cancer causing potential, it takes five years, involves 400 rats (each of which is treated with the maximum tolerated dose), and more than 50% of the results are positive, even worse, of that 50%, 90% are false positives (Abbott). In looking more at the argumentative side, there are two general views: in favor of animal testing or against animal testing. Many people lean towards being against animal testing because they feel it is cruel, inhumane, and unfair to the animals. Now on the other hand, a lot of people are in favor of animal testing because it helps to test medicines, medical procedures and other necessities. Animals do not have a voice of their own; they need people to speak for them, to fight for them, and to protect them. Many companies, while attempting to verify their products are safe for humans, will perform various tests on animals. Animals are used for testing a wide variety of chemicals and products such as drugs, vaccines, cosmetics, household cleaners, and pesticides. As written by Delmas Luedke, ââ¬Å"Animals are exposed to too much suffering; especially when there are many alternatives to testing on animalsâ⬠(Animals and Research). If there are alternatives for research, why test on animals? There are new alternatives being created, such as realistic software models. The first realistic software models of human and animal organs are starting to emerge ââ¬â potentially replacing some of the 50 to 100 million animals used each year for scientific researchâ⬠(Biever). With different types of software emerging, it is very possible for other software to be produced in future years and animal tests could be completely replaced. When doing medical, cosmetic, or any other type of re search, animals should not be used or abused because it is cruel and harmful to the animals being used for testing. On the opposing side, some people believe that it is okay to harm animals in order to discover cures and generate medicines, although animal testing can lead to antibiotics, vaccines, and other treatments being produced, there are other ways that those same products could be produced ââ¬â without harming animals. According to Cynthia Pekow, ââ¬Å"Although polls say that most Americans accept that research animals are needed to advance medical science, many people feel squeamish thinking about animals used in experimentationâ⬠(ââ¬Å"Animals in Researchâ⬠). People do not feel squeamish because their medicines are being tested on animals; they are squeamish because animals are being harmed in the process. While good things have come from testing on animals, it is just not worth the pain and torture that they are put through. One reason why testing on animals should be illegal is because it is a cruel and inhumane way to do research, and it is unfair because animals have no voice of their own. Jackie Powder states that, ââ¬Å"It was a furor over the alleged mistreatment of rabbits by a cosmetics giant that set the stage for the creation of the Center for Alternatives to Animal Testingâ⬠(Powder). CAAT works with scientists, government regulators, and other advocates to identify alternatives to the use of animals in testing thousands of chemicals. Humans are capable of giving their consent in order to be tested on, while animals are not. Animals have no voice of their own to speak with. They cannot tell anyone when something hurts; they cannot tell anyone when something does not feel right; they cannot tell anyone if they do not want to participate in the testing anymore. A second reason for not testing on animals is because there is no moral reason to test on animals when the results may not even be accurate. There have also been many alternatives that have proven to be more accurate than using animals. ââ¬Å"Using animals is unreliable and inaccurate because of great differences between animals and humans. Non-animal tests take less time to complete, cost only a fraction of what the animal experiments the non-animal tests replace costs, and are not overwhelmed with species diversity that make inferring results difficult or impossibleâ⬠(Stop the use, ). Virtual models, such as the ones at Insilicomed in Lo Jolla, California, are being created. At Insilicomed they are using a virtual heart to simulate the interaction between the organ and a pacemaker, on behalf of a manufacturer. The device is initially tested in both animals and software to ensure that the models accurately replicating what happens in real life, but subsequent test to refine the properties the pacemakerââ¬â¢s leads are done in software aloneâ⬠(Biever). With these models being produced, fewer animals will b e used in experiments. Whenever there is a chance to replace animal tests, those chances should be pursued so that fewer animals will be used. On the alternative side of the argument, there are multiple reasons why animal testing is a good thing. For starters, animal testing has helped to create many of the medicines in our world. The kinds of benefits from animal research that researchers have made in understanding and treating diseases would not have been possible without animal research. Many people argue about how it is cruel and inhumane to animals; well would they rather it was humans being tested? Maybe they would like to send their brother or sister in for experimental testing? While animal testing may seem cruel, the hypothetical alternative is even worse. Scientists are attempting to develop worthy alternatives to testing on animals, but some things are not quite as easy to come up with an alternative. Both sides of the argument have very good points, however, despite the fact that it can be seen as cruel and inhumane to the animals (from a personââ¬â¢s perspective), animal testing is, at this point in time, a necessity. There are many drugs and medical procedures that may not be here today if it were not for animal testing. Testing on animals may be inhumane to them, but it is better to be inhumane to an animal than to a human.

Marketing fundamentals essay Introduction In 1964 Neil H. Borden published the article: The Concept of the Marketing Mix. The marketing mix in Bordens concept originally included product planning; pricing; branding; channels of distribution or place; personal selling; promotions; advertising; packaging; display; servicing; physical handling; and fact finding and analysis, (Zineldin and Philipson, 2007, p231). According to this concept, the list of twelve ingredients of the marketing mix is adjustable. It could depend on what kind of elements or areas researchers want to focus on or emphasize to change more, but in The Concept of Marketing Mix, Borden (1964) already explained explicitly why he chose the twelve elements as the marketing mix. However, even though the idea of the marketing mix is derived from Borden, the 4Ps marketing mix which is known to the public was introduced by Jerome McCarthy: Product, Price, Promotion, Place (Constantinides, 2006; Gummesson, 2008). As Anderson and Taylor (1995, p2) claim: The major step in popularizing the marketing mix was the publication of Jerome McCarthys, Basic Marketing: A Managerial Approach in 1960. The purpose of this paper is to discuss whether the marketing mix is still a suitable approach to modern day marketing. For instance, with new technology and subsequent changes in peoples lifestyles, new marketing concepts are springing up, such as relationship marketing and service marketing. Therefore, is the marketing mix still useful today, or should it be improved or even replaced by other new themes; this is a controversial area. The marketing mix and relationship marketing A lot of criticisms are fined at McCarthys 4Ps model because researchers generally think that 4Ps are too simplified. Those who attack the paradigm have suggested that the model should have more factors added into it (Traynor, 1985; Magrath, 1986; and Doyle, 1994) or even use other factors, such as 4Cs to substitute 4Ps (Lauterborn, 1990). Grà ¶nroos (1994) even stated that it is time for the marketing mix to step down and let a new paradigm shift emerge. Moreover, during the past few decades, the debate that the marketing mix needs to be replaced by other new paradigm shift marketing concepts is going on (Constantinides, 2006; Gummesson, 2008). As discussed by Grà ¶nroos (2006), relationship marketing is one of the strongest candidates among so many competitors who are eager to substitute the marketing mix. Furthermore, as Grà ¶nroos (1994, p5) states: In marketing education, teaching students how to use a toolbox had become the totally dominating task instead of discussing the meaning and consequences of the marketing concept and the process nature of market relationships. This indicates that the marketing mix is a good model and memorable for students to understand the general marketing strategy concept. It may, nonetheless, limit students creativity idea in order to fit the framework at the same time. In fact, the marketing mix is still adopted by many scholars and is published in the majority of textbooks, but some have argued that customer relationship is an emerging trend in recent years (Grà ¶nroos, 1994). It is common that, if patients are ill, they have to put their name on a long waiting list . Sometimes even if they have already made an appointment, due to too many patients in the same time period, they still need to wait. Moreover, after a long waiting time, when it is finally their time to see doctors, most of the time doctors are not so friendly. However, this kind of situation is totally different now. Health care industry is no longer a monopoly. As more hospitals are established, the competitions become more intense. As a result, owners of health care organizations start to emphasize the relationship between doctors and patients. In addition, managers also think that employees who may contact with customers are all part-time marketers (Gummesson, 1990). The main factor to cause this kind of change is that buyers (patients) have more choices nowadays. For instance, if there are two sellers (doctors) equipped with the same conditions, but one provides more support on intangible service and has good relationships with buyers, then buyers will definitely go to the one who shows more concern for them. Consequently, managers of health care organizations have to value patients and doctors relationships or they may keep losing customers. This also shows that relationship marketing is a new trend now. While it is interesting to note that some researchers attack the marketing mix is being outdated and in fact that it cannot be deemed as an unchallengeable foundation of marketing, they believe that it formed almost 40 years ago; the concept of it, they argue, in contemporary business or academic research is no longer useful. By contrast, relationship marketing is the new upcoming theme of marketing. Relationship marketing is neither original thinking nor a novelty theory, but it has already been in existence for quite a long time. Zineldin and Philipson (2007, p229) argue that relationship marketing is one of the oldest approaches to marketing. As early as about 25 years ago, the term was introduced as a strategy to service marketing by Berry in 1983, according to Crosby and Stephens (1987). By comparing the transaction-oriented marketing, which is part of the marketing mix feature with relationship marketing, most companies still put emphasis on attracting new customers rather than focusing on establishing a long-term relationship with their existing customers. As reported by Zineldin and Philipson (2007), finding new customers costs less than retaining current customers. Moreover, having a long-term relationship with clients is indeed profitable, but consumers desire is also endless. With more services are provided and a variety of products are easy to access currently, consumers just will want more rather than less, and their mind changes frequently. Accordingly, for companies to maximize profits immediately is both necessary and important for them (Zineldin and Philipson, 2007). Furthermore, relationship marketing focuses on not only the connection amid corporations and customers, but also the relationship between corporations. Consequently, relationship marketing may not be the case for all corporations. For example, if a tin companys ingredients are all from the same supplier, then once the food that the supplier offers has a problem, then the tin companys business will definitely be affected by lack of ingredients. As a result, some companies may not want to rely on another company too much (Zineldin and Philipson, 2007). The other point many academic scholars criticize about the marketing mix is that some standard marketing ingredients are not integrated with the marketing mix into textbooks to become a complete whole body (Grà ¶nroos, 1994;Gummesson, 2002). They are just like toppings on the pizza: the toppings are those additional Ps and the model of 4Ps is the base. The reason why it causes this kind of outcome is owing to model being oversimplified, from a list of elements into four Ps. However, at the same time it cannot be denied that the contribution of the marketing mix and four Ps is significant (Jobber, 2007). Although a lot of new concepts have emerged, it does not mean that the marketing mix will be replaced. To some certain extent, it is still a useful approach and provides a fundamental theory for people who want to study or explore this field. By combining the marketing mix with other spring up theories, it can allow marketing theory to become better. Even Grà ¶nroos is against the m arketing mix, but he also claims the following (1994, p14): [E]ven if marketing mix management is dying as the dominating marketing paradigm and the Four P model needs to be replaced, this does not mean that the Ps themselves, and other concepts of the managerial approach such as market segmentation and indeed the marketing concept (McKitterick, 1957; Keith, 1960), would be less valuable than before. Relationships do not function by themselves. Hence, no matter how marketing concepts develop, the root of these new paradigms is related to the marketing mix. It is of course relevant to contemporary marketing means and still regarded as a core value of marketing. The marketing mix and e-commerce marketing In the 21st century, business may not only be based on physical activities, but also on virtual activities. Therefore, discussing whether the marketing mix can be adapted to e-commerce is a signal to see if it is still relevant to contemporary thinking. As Peattie (1997, p142) point out: Although the marketing implications of emerging electronic or virtual markets are being discussed, the implications for the management of the marketing mix are often being overlooked. Already many innovative companies are taking advantage of the new generation of technologies to enhance or re-engineer key elements of the marketing mix, giving marketing a leading role in introducing companies to the revolutionary world of third age computing. They stress that the marketing mix in this industry is revolutionizing and 4Ps have another new definition to fit e-commerce and marketing function. In a practical aspect, it had been put into practice for many organizations (Peter and Olson, 2005). In addition, virtual value chain also used 4Ps to illustrate the effect of it on electronic business (Bhatt and Emdad, 2001). Many companies still use the marketing mix and 4Ps as their strategy, but with little change on the traditional 4Ps. Allen and Fjermestad (2001, p22) also indicate that Although many of the e-commerce strategy frameworks offer a unique contribution to strategic planning, integrating these models into the traditional product, price, place and promotion framework can provide a more complete analysis of strategy. It reinforces the view that the marketing mix and 4Ps are the cornerstone of marketing and the basis of strategy marketing. More importantly, it is still applied to 21st century new trend business, electronic commerce. In consequence, it is identified that the marketing mix just needs some small changes to be integrated well with other re-discovery concepts; it then plays the most vital role in contemporary marketing theory yet. Conclusion The marketing mix and marketing are just like the constitution is to a country. Constitution is the foundation of a nation. The law may be changed or adjusted with time because the environment and the way people think is greatly different from that of those who were born 50 years ago. Consequently, it is unavoidable that the law should be changed, eliminated or have more rules added to it. Nevertheless, no matter how the rule is amended, the basic rule is always there. It represents a countrys spirit and belief, and this is unchangeable. Hence, this is just as the marketing mix to marketing, in my opinion. Even though some scholars criticize that marketing is not an appropriate approach currently, it needs to be replaced with other rising marketing principles. Nonetheless, common terms such as relationship marketing, service marketing and e-commerce marketing, are focusing on just a part of marketing. They can tackle the problem of a specific area but the marketing mix and 4Ps are the basis of a much more general theory. Moreover, although those who attack the marketing mix for being an old concept and of less relevance today, they also support that the relationship between the marketing mix and marketing is still very close. The influence of the marketing mix is still strong today but certainly not as profound as it has been in the past, and indeed the concept of it still shows signs of practical implementation in contemporary society. Last winter sixty people in New York alone had heart attacks and died from shoveling. People need to know when to stop and take a break to prevent this from happing.
